This is the Privacy Policy of Phantom 360, LLC. and its affiliated entities (hereinafter referred to as “Phantom 360”, “us” or “we“ ) This Privacy Policy describes how your personal information is collected, used, and shared when you provide Phantom 360 with information that can be used to identify you (hereinafter referred to as “Personal Data and/or “Information” ).

Effective January 1, 2025, Phantom 360 has updated its Privacy Policy and how we use and process Personal Data that you share with us as part of providing you with concierge transportation services throughout the contiguous United States (hereinafter referred to as “Service(s)”) .

Phantom 360 respects your privacy and will only process and use your Personal Information as part of providing you with our Services. This Privacy Policy outlines our business practices on the use of Personal Data collected through our engagement with you through our Mobile Application, our Website and our Call Center (hereinafter collectively, “Channels ”). We will only collect and use Information from you as described in this Privacy Policy.

This Privacy Policy addresses Phantom 360’s use of Information collected through our Channels, and you hereby acknowledge and accept our business practices as outlined in this Privacy Policy and give us explicit permission to use your Personal Data in providing our Services. We will not sell your data to any third parties.

PERSONAL INFORMATION COLLECTED

When you use the Service, we collect the following types of Personal Information:

Account Registration Information

In order to sign up, you must create an account by providing us with your email address, full name, and/or business name, phone number, physical address, and a password. To reserve an actual rideshare service, you will need to provide a pick-up address and valid credit card information. We may need to store encrypted credit card information and use it for both billing and payment purposes. You may also be prompted to create a username and upload a picture or avatar to use for comments, ratings, reviews and/or forums.

Information Collected Automatically

Even if you are only a visitor to our Website or user of the Mobile Application, your computer or device will automatically send technical information to our web servers, which we store in log files, including but not limited to the following types of information (hereinafter referred to as “Website Usage Data” ):

  • your viewing activity
  • date and time stamps of the visit and the duration of use of the Website or Mobile Application and related metadata;
  • IP address of your device as well as your internet service provider (ISP);
  • referring/exit URL;
  • sub-sites visited on the Website
  • clickstream data; and
  • information about your device (type of device, browser type and version, as well as settings, installed plug-ins, and the version of the operating system.

Website Usage Data

We process Website Usage Data to allow you to surf the Website and Mobile Application without errors and to ensure its functionality. We also process Website Usage Data to perform analyses on the performance of the Service, to continuously improve the Service and correct errors, to ensure IT security and operation of our systems, as well as to prevent or uncover abuse. We further process this data in aggregated or pseudonymized form to analyze trends, administer the Service, track users’ movements throughout the Website and Mobile Application, and to gather demographic information about our user base as a whole or to improve marketing (including serving you personalized, interest- based ads) as well as the user experience offered on our Service and guaranteeing the safety of our Information Technology systems.

We may also automatically collect device-specific information when you install, access, or use our Service. This information may include data such as the hardware model, operating system information, app version, app usage and debugging information, browser information, and device identifiers.

Payment Information

You must provide valid payment and/or credit card information if you wish to sign up for an account, book a rideshare concierge service, and/or make any other purchase on the Website or Mobile Application. Except for the name associated with your credit card and information about the transaction (e.g., time of transaction, amount), payment information is collected directly by a third-party payment vendor and is not received or stored by us.

Transaction Data

In relation to your Concierge Transportation Service reservation you make via our Website or Mobile Application, we will process your contact and billing information, such as your full name, billing address, and credit card information. You can view the exact information required in the form provided at point of purchase. We will only use this data to provide Concierge Transportation Services, for billing purposes, and for internal accounting.

Comments and Feedback

We may offer the ability to provide comments, reviews, ratings, and capability to post and exchange messages in a forum. Any posts you make will be publicly available within the Service. When using the Mobile Application and with your consent, Phantom 360 will use your transportation reservation data in order for you to more easily provide feedback about your experience with the Mobile Application and Service.

Account Data

On some of our Channels you may register for an account with your e-mail address, full name, username, password and/or encrypted credit card information. If you choose to register, you will automatically create an account. This registration will enable you to manage your account, profile and communication settings, including making updates to your Personal Data. You can create a profile, which may include your Personal Data. We will store your account data for you to be able to communicate interactively with others, including third party drivers, on our Website and Mobile Application.

Location Information

When you use our Mobile Application, you may consent to share your geo-location details with Phantom 360 in order to automatically set your pick-up time and location. We may use and store information about your location to provide features and to improve and customize the Concierge Transportation Services. We will only share your geo-location details with third parties in order to provide you with optimal Concierge Transportation Services. You agree that for proper functionality of the Mobile Application that you will share your exact location with us, and you will have the right to disable location sharing when not active on the Mobile Application.

Analytics Information

We use data analytics to ensure website and Mobile Application functionality and improve the Concierge Transportation Services. We use mobile analytics software to allow us to understand the functionality of the Mobile Application on your device. This software may record information such as how often you use the Mobile Application, what happens within the Mobile Application, aggregated usage, performance data, application errors, debugging information, and where the Mobile Application was downloaded from. We do not link the information we store within the analytics software to any personally identifiable information that you submit within the Mobile Application.

Affiliated Passenger Information

Phantom 360 may receive or obtain information (for example, an email address) about a person who is not registered with Phantom 360 but who may have indirectly used or benefitted from Phantom 360’s Services (hereinafter referred to as an “Affiliated Passenger” ) in connection with certain Phantom 360 features (e.g., when an additional passenger is added to the ride reservation). Affiliated Passenger(s) information is used only for the purposes disclosed when it was submitted to Phantom 360.

Other Information

You may also choose to provide other information about yourself in connection with surveys, contests, coupons, special offers, customer support inquiries, and other communications with Us.

HOW WE USE COLLECTED INFORMATION

We may use the information collected about you to do the following:

  • fulfill your Concierge Transportation Service Reservation(s) and deliver content to you;
  • send marketing communications (depending on your preferences);
  • provide customer support;
  • analyze how the Service is being used for troubleshooting and improvements;
  • communicate with you;
  • collect debts, prevent fraud, and protect the integrity of the Service; and
  • enforce our legal rights.

DISCLOSURES TO THIRD PARTIES

We may disclose your information to the following types of third parties:

Authorized Service Providers

We may share your information with authorized service providers involved in operating the Service. For example, Phantom 360 uses third party service providers to power our Service and provide customer support. Our authorized service providers may include payment providers, email service providers, and analytics companies.

Legal Disclosures

We may disclose your information when we have a good faith belief that compliance is required by a search warrant, subpoena, court order, or similar request from law enforcement or other government agency.

Public Disclosures

We may publicly disclose aggregated user statistics and other information, which is not considered Personal Information. If you comment or participate in a forum, your comment will be shared publicly.

Electronic Mailing Subscriptions

When you create an account, you may receive transaction emails when you first create the account. We may send you a welcome email that provides information about your subscription and your account. If you make a reservation or a purchase, we will send you an email confirming your reservation or purchase. We may also send you other emails concerning your account status and renewals. You may not opt out of transactional emails. Depending on your preferences, we may send you marketing emails informing you about new features, updates, or promotions. You may opt out of such marketing emails at any time via your account settings.

PRIVACY RIGHTS

You may change your account information or close your account at any time by logging into your account and adjusting your account settings. If you close your account or request that we delete your account, you may lose access to content you have posted or purchased. When you close your account, we may preserve your account information to (i) let you know about new offers and content; (ii) restore your account, if you ever wish to re-join or re-subscribe; and (iii) where we believe in good faith that preservation is necessary to enforce our rights.

CHILDREN’S PRIVACY

The Service is not intended for individuals under the age of 18. If you are a parent or legal guardian who has discovered that your child has provided personal information through the Service without your consent, please contact us so that we can remove any unauthorized information.
